Data retention

The Data Controller retains the data for the time necessary to obtain anonymous statistical information on the use of the site and to check its correct functioning. Personal data will be stored for the period necessary to pursue the purposes mentioned above; in particular, personal data collected for purposes related to the legitimate interest of the Data Controller will be processed and stored until this interest is satisfied, without prejudice to a further retention period imposed by law or by explicit request by the authority. Recipients of the data

The Data Controller does not communicate any personal identification data or information to third parties except, as may be and as far as strictly necessary, to those who intervene as suppliers for the provision of services relating to the management of the website and for the consequent management of the contractual relationship and related administrative obligations, as well as to those who provide IT services or commercial electronic communications services.

Data transfer

Under no circumstances is there any provision for the transfer of personal data to a third country or to an international organisation (Art. 13, subsection 1, letter f) of the GDPR). However, the Data Controller reserves the right to use cloud services, in which case the service providers appointed as Data Processors pursuant to and for the purposes of Art. 28 of GDPR 2016/679, limited to the performance of specific processing activities, will be chosen from among those companies certified in accordance with ISO 27001 standards (information security),ISO 27017(cloud security),ISO 27018(cloud privacy).

Rights of the Data Subject

The Data Subject to whom the personal data refer has the right to exercise his/her rights at any time (pursuant to Art. 15-22 of the GDPR) in order to obtain:

  • confirmation as to whether or not personal data concerning him or her is being processed and obtain access to the data and the following information (purposes of the processing, categories of personal data, recipients and/or categories of recipients to whom the data have been and/or will be communicated, retention period);
  • rectification of inaccurate personal data concerning him or her and/or supplementing incomplete personal data, including by providing a supplementary statement;
  • erasure of personal data, in the cases provided for by current legislation;
  • restriction of processing, in the cases provided for by current legislation;
  • data portability, in particular to request personal data concerning him or her from the Data Controller and/or request that the Data Controller transmit his/her data directly to another Data Controller;
  • opposition to the processing of personal data concerning him or her, in the cases provided for by current legislation.

With regard to the exercise of their rights, Data Subjects may address their requests by means of a specific communication by post addressed to the Data Controller (at the address indicated above) or by sending a communication to the e-mail address IT.Milan.KerryProject.Privacy@kln.com, specifying the subject of their request, the right they intend to exercise and attaching a photocopy of an identity document certifying the legitimacy of the request.

Right to lodge a complaint

Data Subjects who believe that the processing of personal data relating to them is in violation of the provisions of the Regulation, have the right to lodge a complaint with the competent privacy watchdog according to the procedures provided on the website www.garanteprivacy.it (pursuant to Art. 77) or to take appropriate legal action pursuant to Art. 79 of the Regulation (GDPR).

Applicable law and jurisdiction 

These terms and conditions are governed by Italian law. Any dispute that may arise regarding the interpretation, application or execution of these conditions will be referred to the exclusive jurisdiction of the Court of Milan.
